These Terms of Service ("Terms") govern your access to and use of UptimeKing ("the Service"), operated by UptimeKing ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

1. Acceptance of Terms

By accessing or using UptimeKing, you confirm that you are at least 16 years of age and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Your continued use of the Service after any modifications to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

UptimeKing is a website, API, and infrastructure monitoring platform that provides:

  • HTTP, ping, and port monitoring with configurable check intervals
  • Heartbeat (cron job) monitoring
  • SSL certificate and domain expiration monitoring
  • Alert notifications via email, Slack, Discord, Telegram, and webhooks
  • Public status pages with incident management
  • Uptime statistics, response time tracking, and historical data
  • REST API access for programmatic management

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and API tokens
  • Notify us immediately at [email protected] if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account
  • Not share your account credentials with third parties

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Free and Paid Plans

Freeman Plan

The Freeman plan includes up to 5 monitors with 60-second check intervals, email alerts, and SSL monitoring. The Freeman plan is available indefinitely with no credit card required. We reserve the right to modify the Freeman plan's feature set with 30 days' notice.

Paid Plans

Paid plans (Knight, Lord, and King) are billed monthly or annually, in advance. Pricing is listed on our website and may be updated with 30 days' notice to existing subscribers.

Billing

  • All payments are processed securely through Stripe
  • Subscriptions automatically renew unless cancelled before the next billing cycle
  • Prices are listed in USD and exclude applicable taxes
  • Failed payment attempts will be retried according to Stripe's retry schedule; accounts with unpaid invoices may be downgraded to the Freeman plan after 14 days

Refunds

We offer a full refund within 14 days of your first paid subscription. After the initial 14-day period, subscriptions are non-refundable. Downgrades take effect at the end of the current billing period. If we discontinue a paid feature, affected users will receive a prorated refund.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your paid features remain active until the end of the current billing period, after which your account reverts to the Freeman plan. Monitoring data beyond Freeman plan retention limits will be deleted 30 days after downgrade.

5. Acceptable Use

You agree not to use the Service to:

  • Conduct DDoS attacks or load testing: The Service is for monitoring, not stress testing. Do not configure monitors with the intent to overload target servers.
  • Harass or abuse targets: Do not use the Service to repeatedly probe endpoints with the intent to disrupt, harass, or interfere with their operation.
  • Abuse the Freeman tier: Creating multiple accounts to circumvent Freeman plan limits is prohibited. We may merge or terminate duplicate accounts.
  • Distribute malware or phishing: Status pages must not be used to host or distribute harmful content.
  • Violate laws: You must comply with all applicable local, national, and international laws when using the Service.
  • Resell without authorization: You may not resell access to the Service without a written reseller agreement.
  • Interfere with the Service: You must not attempt to probe, scan, or test the vulnerability of the Service, or circumvent any security or rate-limiting mechanisms.

We reserve the right to throttle, suspend, or terminate accounts that violate these acceptable use policies without prior notice.

6. Service Availability

We aim to maintain 99.9% uptime for the UptimeKing platform itself. However:

  • No SLA on the Freeman tier: Freeman accounts do not include any service level guarantees. We provide the Freeman tier on a best-effort basis.
  • Paid plan SLA: For Knight, Lord, and King plans, if monthly uptime falls below 99.9% due to our infrastructure (excluding scheduled maintenance), you may request a prorated credit for the affected period.
  • Scheduled maintenance: We may perform maintenance with at least 24 hours' notice posted on our own status page. Scheduled maintenance windows are excluded from uptime calculations.
  • Force majeure: We are not liable for downtime caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet backbone failures, or third-party service outages.

7. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by UptimeKing and protected by intellectual property laws. You retain ownership of all data you submit to the Service, including monitor configurations and custom status page content.

You grant us a limited license to use your data solely for the purpose of providing and improving the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • UptimeKing is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all downtime events on your monitored endpoints.
  • In no event shall UptimeKing's total liability exceed the amount you paid us in the 12 months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
  • We are not responsible for damages resulting from downtime of your own services, whether or not our monitoring detected the outage.

9. Indemnification

You agree to indemnify and hold harmless UptimeKing, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use policy
  • Your account has been inactive for more than 12 months (Freeman tier only)
  • We are required to do so by law
  • We cease to offer the Service (with at least 60 days' notice and data export opportunity)

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination to allow you to export it, after which it will be permanently deleted.

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable rules. You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

12. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes by:

  • Posting the revised Terms on this page with an updated effective date
  • Sending an email notification to the address associated with your account for significant changes

Changes take effect 30 days after notification for existing users. Continued use of the Service after the effective date constitutes acceptance. If you disagree with the changes, you may cancel your account before the effective date.
